Course Purchase Terms (Profoto Academy)


1. Scope and Parties

These Course Purchase Terms (the “Terms”) apply between Profoto Aktiebolag, Reg. No. 556115-5838, a limited liability company incorporated under the laws of Sweden (“Profoto”), and a customer (“Customer”) purchasing any digital training, streaming video, or related educational content (“Courses”) from Profoto’s website academy.profoto.com (the “Website”).

These Terms shall not limit or exclude any rights or obligations that cannot be excluded under mandatory law. In case of conflict between these Terms and mandatory law, the latter shall prevail.

2. General

Profoto offers professional photography education through online streaming Courses. Courses can be purchased and accessed through academy.profoto.com.

Information about each Course, including price, duration, access rights, and technical requirements, is displayed on the Website. Temporary promotions or discounts are valid only for the duration stated and cannot be combined with other offers.

Profoto does not guarantee that all content on the Website is always complete, accurate, or error-free. Profoto reserves the right to modify course content, prices, and availability at any time without notice.

3. Orders and Payment

By placing an order, the Customer agrees to pay the full price for the Course as shown on the Website at the time of purchase. Payment is collected at checkout using the available payment methods for the Customer’s country of residence.

A binding agreement is formed when Profoto confirms the order and the Customer receives an order confirmation via email. Access to the Course will be granted once payment has been received in full.

All prices are displayed in the applicable currency for the selected market and include taxes, unless otherwise stated.

4. Access and Availability

After purchase, the Course is made available for streaming via the Customer’s account on academy.profoto.com. Courses are accessible 24/7 as long as Profoto makes the content available on the Website.

Profoto does not guarantee uninterrupted access and may temporarily suspend the Website for maintenance or updates. Such interruptions do not constitute a breach of these Terms.

Profoto reserves the right to discontinue or replace specific Courses with one month’s notice. If a Course is permanently removed, Customers who purchased access within the last 30 days will be offered equivalent replacement content or a refund.

5. Technical Requirements

To stream Courses, the Customer must have internet access and a compatible device. A minimum connection speed of 768 kbps is required, though Profoto recommends at least 5 Mbps for HD streaming.

Courses can be viewed using modern browsers that support HTML5 video playback, such as Google Chrome, Safari, Firefox, and Microsoft Edge. It is the Customer’s responsibility to ensure their device and browser meet these technical requirements.

6. Intellectual Property

All Courses and related content are owned by Profoto and protected by copyright and other intellectual property laws.

Customers receive a limited, non-exclusive, non-transferable, and revocable license to view and use the purchased Course for personal educational purposes only. The Customer may not copy, record, reproduce, share, resell, or publicly display any part of the Course. Access credentials must not be shared with third parties.

Profoto reserves the right to revoke access and terminate accounts in case of misuse, sharing, or violation of these Terms.

7. No Right of Withdrawal

Since Courses consist of digital content made available immediately after purchase, the Customer acknowledges and agrees that the right of withdrawal does not apply under applicable EU consumer legislation once access has been granted.

8. Limitation of Liability

Profoto provides the Courses “as is” and does not warrant that the content will meet the Customer’s specific requirements or expectations.

To the extent permitted by law, Profoto shall not be liable for any indirect, incidental, or consequential losses, including but not limited to lost profits, data loss, or business interruption. Profoto’s maximum liability under these Terms shall not exceed the amount paid by the Customer for the relevant Course.

9. Processing of Personal Data

Profoto processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable local laws. Information about how Profoto processes personal data and your rights as a data subject can be found in Profoto’s Privacy Policy.

10. Governing Law and Disputes

These Terms are governed by the laws of Sweden, excluding its conflict of law principles. Any dispute arising from these Terms shall be finally settled by the District Court of Stockholm (Stockholms tingsrätt), Sweden.
